Application

These Terms of Use apply to Services provided by Arête Gold AB through the website aretegold.se (the “site” or “Arête”).

These terms apply to all who use the site and register an account, hereinafter “Customer” or “User”.

Conditions for use

All use of the Arête Services is conditional upon you as a User accepting these Terms of Use, which you also confirm when creating a User Account.

You can stop using the Service at any time by deleting your account. These conditions apply for as long as there is an active User Account.

The Service

Arête is a website where people can learn about the operations of Arête Gold AB.

Use of the Service

To use the Service, you first must create a User Account by registering using your name and email. In order to create an Account you must be at least eighteen (18) years of age or have your legal guardian's prior consent.

By registering an account, the Customer is granted a non-exclusive and non-transferable right to, for their own use, use the Service and the Information in accordance with these terms.

As a User, you are responsible for all use of the Service and for your login information to be protected from unauthorized access. It is not allowed to transfer or allow someone else to use your account.

By accepting these Terms of Use, you warrant that you will not use the Service for any purpose that violates applicable laws, government regulations or otherwise may cause harm or inconvenience to Arête or any third parties. You also represent and warrant that you will not:

• gain access (or attempt to gain access) to any area where you do not have a right or permission to be;
• distribute viruses, malicious software, use any worms, trojan horses, cancelbots, spyware, corrupted files, time bombs, robots, scrapers, spiders or any other automatic means to access, damage, disrupt or interfere with the Services for any reason;
• modify any file or any other part of the Services that Arête does not specifically authorize you to modify;
• frame, mirror or otherwise incorporate any part of the Services into any other Services, software or Service without our prior written authorization;
• bypass, circumvent or interfere with any technical measures used by us to provide the Services;
• sell, buy, trade or otherwise transfer your User Account, any personal access to the Services or any content associated with your User Account.

Price and Payment Terms

The service is exclusive to and free for approved Arête shareholders.

Term and termination

The membership runs without a binding period and the User may terminate their account at any time in the “User Settings” page.

Termination must take place directly on the User’s profile page to be valid. A termination means that the User Account will be deleted after a 7-day notice period. Termination also means that the information uploaded by the Customer to the Service is permanently deleted. During the notice period the User may cancel the request to terminate and continue to use the Service.

Processing of personal data

When you register as a Arête User, Arête will process your personal data in order to provide the Service and to fulfill its obligations according to this Agreement. Arête warrants that all such personal data will be processed in accordance with the applicable General Data Protection Regulation (GDPR).

Arête only collects the personal data that you have provided yourself in connection with the registration of your account.

The Customer acknowledges and agrees that Arête may engage Sub-processors in connection with the provision of the Services, including without limitation the Processing of Personal Data. For more detailed information on how we process your Personal Data please review our Privacy Policy.

Confidentiality

The User is responsible for protecting license keys and other sensitive information, such as passwords, which are linked to Arête. The User undertakes to promptly notify Arête of any possible abuse of the Service and to any kind of security breach relating to the Service.

Intellectual Property Rights

All rights to the Service and Information, software and its content, including copyright and other intellectual property rights, belong to Arête or such third parties with whom Arête has entered into an agreement. The User does not obtain any right to the Service, Information, software or its content beyond what is expressly provided for in these terms and conditions.

As a User of the Service, it is not permitted to copy, modify, distribute or otherwise disseminate information and content from the Service to the public via the internet or in any other way.

By accepting these terms of use you confirm that you understand and accept that any violation of Arête’s intellectual property rights could entail liability to pay damages to Arête.

Limitation of liability

Arête intends to keep all information on the website correct and as updated as possible. The information used in the financial model and the research report is collected from several different public registers and databases and then compiled and made available to you as a User. Arête can therefore not guarantee the correctness of such information.

Arête is not in any way responsible for any liability, loss or damage that arises due to the content of data or other information conveyed when using the Service or the actions taken by the Customer as a result of using the Service.

Furthermore, Arête does not guarantee that the use of the Service will be uninterrupted or free of errors and is therefore not responsible for any technical errors, regardless of the cause of the errors, or other disturbances in the availability of the Service caused by, for example, insufficient internet connection, disturbances at the web host or in connection with updates and maintenance.

The total liability of Arête, for all claims under these terms, including for implied warranties, shall be limited to the amount paid by the Customer for the use of the Service. The above limitation of Arête's liability for damages does not apply in the event of intent or gross negligence on Arête’s part.

Under no circumstances shall Arête be liable for any loss or damage that is not reasonably foreseeable.

Arête's right to suspend Users

Arête reserves the right to unilaterally decide to suspend Customers from use of the Service. Suspension may occur, for example, as a result of a violation or reasonable suspicion of breach of these terms and conditions or if the Service is used in a manner that may cause Arête or any third party damage.

Updates and further development

Arête plans to continuously develop, update and improve the Arête Service. All further development is included as part of the subscription and the use of new functionality shall be in accordance with these terms of use, unless Arête informs that the new functionality requires special conditions.

Comments and complaints

Alterations and additions

Arête reserves the right to make changes to these terms of use from time to time.

The terms currently in force are published on the website and as a User you are responsible for making sure you are up to date with any changes.
